ADDITIONAL LICENSE AUTHORIZATIONS HP provides the following software products (“Software”) under the license terms set forth in this Additional License Authorization document (the “ALA”). Products • HP Insight Management Software Products: Insight Control, Insight Control for Linux, Insight Control Server Deployment–RDP, Integrated Lights Out (iLO) Advanced, Integrated Lights Out (iLO) Advanced for BladeSystem, Lights-Out 100i Advanced, Virtual Connect Enterprise Manager, HP CloudSystem Matrix, HP Matrix Operating Environment, HP Systems Insight Manager • HP Active Health System • HP Smart Update Manager • HP Service Pack for ProLiant • HPSreports Authorized Use You may only Use the Software according to the terms of the ALA, in addition to licensing terms in your agreement with HP or in the absence of such separate agreement, HP’s standard End User License Agreement in effect at the time of delivery (the “Agreement”). The Software is a proprietary tool developed by HP for purpose of delivering support services from HP and its Authorized Service Providers. You may Use it only: • If you are an end-user customer, for your internal business purposes as a self-maintainer; or • If you are a support customer of HP or its Authorized Service Provider, for the purpose of receiving such support services; or • If you are an HP Authorized Service Provider, you may Use it for the benefit of end-user customers according to the terms of this ALA and such agreement. Additional license terms A. You shall not access any embedded Database or any other third-party product embedded in the software with applications other than the HP-branded software. B. You must reproduce all copyright notices that appear in or on the Software (including documentation) on all permitted copies or adaptations. Copies of documentation are limited to internal use. C. You accept Software upon delivery. D. Third-party Suppliers are intended beneficiaries under this ALA and independently may protect their rights in the software in the event of any infringement. All rights not expressly granted to you are reserved solely to HP or its suppliers. E. To the extent this restriction is not prohibited under applicable law, and except as specifically authorized under in writing by HP, you shall not disclose to any third party the results of (i) any performance benchmarks you run on the Software, or any portion thereof, or (ii) specific detailed comparisons you make between Software , or any portion thereof, and any product owned by you or a third-party product. F. The Software is confidential and proprietary information of HP (“Confidential Information”). You will hold in confidence and not use or disclose any Confidential Information, except as expressly permitted in the Agreement. Software product-specific license terms Activation Key Agreement (AKA) Customers with a valid Activation Key Agreement (AKA) contract in place with HP are issued specific master installation keys that activate a specified quantity of licenses of the Software over a specified term. Use of the Activation Keys requires the customer to submit a purchase order to HP, or to an HP authorized reseller, referencing the applicable AKA tracking part number for the quantity of licenses activated with the Insight Software Activation Keys prior to, or upon activation of the license. Licenses to the Software are not transferrable from one device to another. Definitions Capitalized terms not otherwise defined in this Additional License Authorizations document are defined in the governing Agreement. Term Definition Database means a container which stores application data including table structure, stored procedures, and other functionality that runs on a Database Instance. Device means an addressable entity, physical or virtual, including but not limited to router, switch, bridge, hub, Server, PC, laptops, handheld Device or printer that resides within the range defined for interrogation and asset tracking. Use means to install, store, load, execute and display one copy of the Software. Third-Party Supplier means an external entity that is contractually engaged by HP to provide services to you, such as consulting or outsourcing services, which require access or use of the software by such entity. Authorized Service Provider (ASP) means an external entity that has been certified by HP to provide service on HP products under warranty, in accordance with HP’s warranty terms and conditions.
